RPM EMPIRE TERMS OF SERVICE

Welcome to RPM Empire (“RPM Empire,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website located at www.rpmempire.com (“Site”), as well as your participation in our sweepstakes, product purchases, SMS program, and other services (collectively, the “Services”).
Please read these Terms carefully. By using our Site or Services, you agree to be legally bound by these Terms, along with our Privacy Policy, Cookie Policy, Official Sweepstakes Rules, and any other policies we post. If you do not agree, do not use the Site or Services.
1. Acceptance of Terms
By accessing or using RPM Empire’s website or services, you agree to comply with and be bound by these Terms and all applicable laws and regulations. We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after any update constitutes your acceptance of those changes.
2. Eligibility and Accounts
a. Age Requirement: You must be at least 18 years old and legally able to enter into a binding agreement. Sweepstakes may have additional eligibility requirements, as detailed in the Official Rules.
b. Account Responsibility: If you create an account, you must provide accurate, current information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately at admin@rpmempire.com if you suspect unauthorized access.
3. Product Orders and Payments
a. Pricing & Availability: All product prices are listed in USD and are subject to change without notice. We reserve the right to limit quantities or cancel orders for any reason, including suspected fraud or inventory issues.
b. Payment Processing: Payments are securely processed via third-party providers (e.g., Stripe, PayPal). RPM Empire does not store your full payment details.
c. Order Verification: For orders over $250, we may contact you to verify your identity to help prevent fraud.
d. Shipping & Fulfillment: Shipping costs, carriers, and delivery times vary by location. We are not liable for delays once packages are shipped.

4. Sweepstakes, Giveaways & Entry Rules
a. Entry Methods: You may gain sweepstakes entries through qualifying purchases or by submitting a mail-in entry, as described in the Official Rules.
b. Entry Period: Entries are valid only during the specified Entry Period listed on the sweepstakes page. Late or incomplete entries will not be accepted.
c. Winner Selection: Winners are selected randomly according to the Official Rules. All winners are required to complete eligibility verification and submit tax documentation (W‑9 or W‑8BEN) before claiming a prize.
d. Prize Fulfillment: Winners are responsible for arranging pickup, insurance, registration, and all related costs. RPM Empire is not responsible for transportation or licensing.
e. Media Release: By accepting a prize, you grant RPM Empire a worldwide, royalty-free, perpetual license to use your name, city/state, photos, video content, likeness, and voice for promotional purposes in any media without further compensation, unless prohibited by law.
f. SMS Program: By opting into SMS messages, you consent to receive automated and recurring promotional and transactional texts from RPM Empire at the number you provide. Message and data rates may apply. Consent is not required for any purchase. Reply STOP to unsubscribe, HELP for assistance. Your use of SMS is subject to our Privacy Policy.
5. User-Generated Content
If you submit content to the Site (e.g., reviews, comments, photos), you grant RPM Empire a non-exclusive, royalty-free, worldwide, perpetual license to use, display, reproduce, and distribute that content. You confirm that you own or have permission to use the content and agree not to post illegal or harmful material.
6. Intellectual Property
All content on the Site—including text, images, designs, logos, videos, and software—is owned by RPM Empire or its licensors and protected by intellectual property laws. “RPM Empire” and its logo are trademarks of RPM Empire. You may not reproduce, copy, modify, or exploit any content without our written permission.
7. Termination
We reserve the right to suspend, restrict, or terminate your access to the Site or Services at our sole discretion, with or without notice, for any reason including violation of these Terms or suspected fraud.
8. Disclaimers
The Site and Services are provided “as is” and “as available” without warranties of any kind. We disclaim all express and implied warranties, including fitness for a particular purpose, merchantability, and non-infringement. We do not guarantee that the Site will be uninterrupted, secure, or error-free.
9. Limitation of Liability
To the fullest extent permitted by law, RPM Empire and its affiliates shall not be liable for indirect, incidental, or consequential damages—including lost profits, data loss, or business interruption. Our total liability shall not exceed the amount you paid to us, if any, for the product or service involved.
10. Indemnification
You agree to indemnify and hold harmless RPM Empire and its affiliates from any claims or damages arising out of your violation of these Terms or misuse of the Site or Services.
11. Force Majeure
We are not responsible for delays or failures caused by events beyond our control, including natural disasters, outages, strikes, or government actions.
12. Assignment
You may not assign your rights under these Terms without our consent. We may assign our rights in connection with a merger, acquisition, or sale of assets.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of North Carolina, USA. Any dispute shall be resolved through binding arbitration or in small claims court. You waive the right to participate in any class action or jury trial. Before filing a claim, you agree to contact us at admin@rpmempire.com to attempt informal resolution.
14. Severability
If any part of these Terms is found unenforceable, the rest will remain in effect.
15. Entire Agreement
These Terms, along with our Privacy Policy, Cookie Policy, Refund Policy, and applicable Official Rules, represent the entire agreement between you and RPM Empire regarding your use of our Site and Services.
